Terms of Service

These Terms of Service ("Terms") govern your use of SendZap.io ("Service") operated by Acelpay, Inc. ("we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Use of Service

SendZap provides an email and SMS marketing platform. You may use our Service to:

• Upload contact lists and manage subscriber data
• Create, schedule, and send email and SMS marketing campaigns
• View analytics and campaign performance data
• Manage subscriptions and billing

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and all activity under your account. You must be 18 years or older to use this Service.

3. Acceptable Use Policy

You agree NOT to use SendZap to:

• Send unsolicited messages (spam) to recipients who have not opted in
• Send content that is illegal, harmful, fraudulent, or deceptive
• Violate CAN-SPAM, TCPA, GDPR, or other applicable laws
• Upload contact lists obtained through scraping or purchased lists
• Impersonate any person or entity
• Use the service for phishing, malware distribution, or harassment

Violation of these terms may result in immediate account suspension without refund.

4. Billing & Subscriptions

Subscriptions are billed monthly. Payments are processed securely by Stripe. You may cancel your subscription at any time through the billing portal — cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.

5. Compliance with Anti-Spam Laws

You are solely responsible for ensuring your campaigns comply with all applicable laws, including CAN-SPAM (email) and TCPA (SMS). All campaigns must include a clear unsubscribe mechanism. You must maintain records of consent from your contacts.

6. Data Ownership

You retain all ownership of data you upload to SendZap. We process your data solely to provide the Service. By uploading contacts, you confirm you have the legal right to market to those individuals.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any losses resulting from service downtime or delays in message delivery by Twilio or SendGrid.

8. Limitation of Liability

To the maximum extent permitted by law, Acelpay shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account for violations of these Terms, without notice. You may terminate your account at any time by contacting support@sendzap.io.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
